Fines for missing QR codes on fiscal receipts suspended until 2026

On November 7, 2025, Romania's Ministry of Finance published a draft Emergency Ordinance proposing to postpone, until November 1, 2026, penalties for companies that issue fiscal receipts without a QR code. The measure comes as the technical rollout of the new requirements is not yet complete. Worth knowing: the legal requirement to use cash registers capable of printing receipts with a QR code remains in force, but fines for non-compliance are temporarily suspended.

What does the Ordinance say?

According to the draft Emergency Ordinance (see the official document), penalties for issuing a fiscal receipt without:

  • the buyer's tax identification code,
  • the receipt identification number,
  • and the mandatory data set out in art. 4 para. (2¹) of Government Emergency Ordinance 28/1999, in the form of a QR code,

are to be suspended for a limited period, until the conditions for technical and legal compliance are in place.

Although public discussion refers to a "suspension" of penalties, in essence this is another postponement of the compliance deadline. That means businesses need to be ready to implement the requirements as soon as the technical rules are published.

Reasons for the postponement

According to the explanatory memorandum, more time is needed for:

  • amending the secondary and tertiary legislation on electronic fiscal cash registers;
  • software development by authorized distributors;
  • testing every cash register model at ICI Bucharest, to obtain the technical approval supplement;
  • actually updating the cash registers, a complex operation that requires service technicians to work on roughly 900,000 active cash registers nationwide.

The situation on the market

Even though ANAF (Romania's tax authority) has not issued any fines so far, in October there were cases in which the Economic Crime Investigation Service (SICE) fined businesses in several cities, including Bucharest, for missing QR codes on fiscal receipts.

Representatives of the Employers' Association of Cash Register Dealers and Service Providers in Romania warned as early as September that although the legal QR code obligation was introduced by Emergency Ordinance 69/2024, implementing it in practice remained impossible without updated methodological rules.

"The National Institute for Research and Development in Informatics, ICI Bucharest, was supposed to test the devices and issue the technical approval supplements, but this was not possible because the rules had not been amended. We are waiting for a new ordinance to clarify the technical requirements and deadlines," the Association's representatives said.

What the QR code on a fiscal receipt means

The QR code is a two-dimensional code that will store key information about the transaction, such as:

  • the date and time of issue,
  • the fiscal receipt identification number,
  • the fiscal serial number of the electronic cash register.

Its main purpose is to simplify tax checks and give the authorities fast, automatic access to system data through a secure digital mechanism.

What happens next?

Until the new methodological rules are published, fiscal receipts without a QR code remain valid and businesses do not risk penalties. Actual implementation is expected during 2026, once the Ministry of Finance and ICI Bucharest release the technical specifications. After that, cash register manufacturers and distributors will have to update the device software so that a QR code can be printed on every fiscal receipt.
